Your account and conduct
By using Chewing Gum you agree to these terms. You must be 18 or older and able to enter a binding agreement. You're responsible for what you upload and for how you behave on and off the service. Don't use Chewing Gum to harass, impersonate, defraud, or break the law, don't upload content that isn't yours to upload, and don't interfere with the service.
Your content
You keep ownership of what you upload. You grant us a worldwide, non-exclusive, royalty-free license to host, store, reproduce, modify (such as resizing or re-encoding), transmit, and display your content as needed to operate the service. If your content includes your name, image, likeness, or voice, you grant us the rights necessary to use those as they appear in your content, solely to operate the service. We may remove content or end your access at our discretion. We don't verify users or vouch for anyone; if you meet someone through the service, you do so at your own risk.
Disclaimers
The service is provided "as is" and "as available" without warranties of any kind, including merchantability, fitness for a particular purpose, and non-infringement, and we do not warrant that the service will be uninterrupted, secure, or error-free. To the maximum extent permitted by law, we are not liable for indirect, incidental, consequential, special, exemplary, or punitive damages, or for lost profits, lost data, or lost goodwill, and our total liability is capped at one hundred US dollars.
Nothing in these terms limits liability that cannot be excluded under applicable law, including for fraud, willful misconduct, or gross negligence. To the extent permitted by law, each party waives any right to a jury trial.
Indemnification
You will indemnify and hold us harmless from any claim, loss, or expense (including reasonable attorneys' fees) arising from your content, your use of the service, your conduct, or your breach of these terms.
Disputes
If something goes wrong, please email support@pieceofgum.com first with a description of the dispute and give us 30 days to try to sort it out. After that, any claim must be brought individually, not as part of a class or representative action, in the state or federal courts located in California, and each party consents to personal jurisdiction and venue there, except that either side may bring a claim in small-claims court. If this class-action waiver is unenforceable as to any claim, that claim proceeds in court severed from any claim that can proceed individually. These terms are governed by the laws of the State of California, without regard to conflict-of-laws rules. Copyright reports may also be sent to the email above.
Changes
We may update these terms; material changes will be noted by updating the date above, and continued use after that date constitutes acceptance. If any part of these terms isn't enforceable, the rest still applies. The sections on content license, disclaimers, liability, indemnification, and dispute resolution survive the end of these terms.
